Please read carefully before making a purchase from my online store. These Terms and Conditions govern the use of the website www.alicepaintings.de and the purchase of any items from my online store. By accessing or using the website, you agree to comply with these Terms and Conditions.
- Orders and Delivery
1.1 Orders are processed and shipped within 7 days upon purchase date unless otherwise stated.
1.2. Standard delivery is possible within Germany (with free shipping), Austria, Belgium, Czech Republic, Denmark, Finland, France, Italy, Liechtenstein, Luxembourg, Monaco, Netherlands, Poland and Sweden (with flat rate shipping). Delivery costs will be displayed at checkout. By purchasing from the shop, you and I agree to these terms.
1.3. Shipping outside of these countries internationally is possible upon request. Different shipping fees will apply.
1.4. Any customs duties, taxes or additional costs from the import of goods into another country are the buyer’s responsibility.
- Prices and Payments
2.1. All prices from the shop include applicable fees and taxes.
2.2. I accept various payment methods, including:

You agree to provide accurate and complete payment information when purchasing from the shop.
2.3. In case of a pricing or payment error, I reserve the right to modify your order and/or contact you for further instructions.
- Returns and Refunds
3.1. In case an item is delivered damaged or defective, please contact me within 7 business days of receiving your order with photos and/or videos of the damaged box or product.
3.2. In cases of damage or loss during transit, I will issue a refund, replacement or return, subject to availability. Refunds will be issued within 7 business days after I receive and verify the state of a returned item.
3.3. To qualify for a return or refund:
– The item must be in its original condition and packaging.
– You are responsible for safe packaging. Inadequate packaging may result in a 50% deduction from the refund.
– Each case will be evaluated individually to find the best solution.
3.4. Colour differences: digital photographs vs. original artwork
– Please note that digital photographs of the artwork displayed on the website may differ from the actual colors of the physical painting, due to variations in screen types, brightness, contrast settings, and ambient lighting.
– Before placing an order and making payment, you are encouraged to request additional photographs or a short video of the actual artwork to assess the colors and details more accurately.
– Once an order has been played and payment has been accepted, color differences between the digital images and the physical artwork are not accepted as valid grounds for a return or refund.
– Returns or refunds on this basis will be considered ineligible, except in cases where the artwork is damaged, defective, or does not match your order.
3.5. Complaints must be submitted within 7 days of receiving the order and must include photographic evidence.
3.6. Return Procedure
If you are not satisfied with the delivery date or wish to return an item for any valid reason permitted under these Terms, you must first notify me by email at aliceobermeierart@gmail.com. Upon approval, I will provide you with a return label and return address details.
3.8. Any unannounced or unauthorized return, or any manipulation of the artwork without prior notice, will void the possibility of a refund. This policy exists to protect unique and original artworks from damage during transit.
- Delivery Issues
– If delivery fails due to the buyer’s fault (e.g., incorrect address), the buyer will cover the cost of re-delivery.
– If the error was mine, I will cover the re-delivery costs.
– If the product arrives at a pickup point and is not collected in time, you must arrange repeat delivery. If refused, no refund will be issued for the product or shipping.
- Intellectual Property Rights
5.1. All artworks, prints, and artistic items on this website are protected by copyright and intellectual property laws.
5.2. Purchasing an item does not grant you rights to the image or concept. Reproducing or using any material without prior written permission is strictly prohibited.
- Limitation of Liability
6.1. While I strive to provide accurate information, I do not guarantee its completeness or reliability. You use this website at your own risk.
6.2. I am not liable for direct, indirect, incidental, or consequential damages resulting from your use of this website or products.
- Governing Law and Jurisdiction
7.1. These Terms are governed by the laws of the European Union.
7.2. Any dispute will be under the exclusive jurisdiction of the courts in Germany. Legal action in another country must be at the buyer’s expense.
- Custom Orders & Additional Information
For commissions, custom sizes, materials, or special requests, please contact me directly at aliceobermeierart@gmail.com. Please include your specifications and image references. Time between making a request can vary and can be set after further discussion. Additional fees (size, shipping) will be discussed individually.
You’ll receive a completion date and payment instructions upon acceptance. Your request will only be processed after full payment.
If I cannot complete the work on time for whatever reason, you will receive a full refund or we will agree on new terms.
Advance payments (the deposit) are non-refundable if the client’s reason for cancellation or refusal is not justified or is unrelated to an error made by the artist.
If the artwork is completed and the client fails to pay the remaining balance, the deposit will not be refunded, and the order will be considered cancelled by the client.
The final payment must be made before the artwork is shipped.
The conditions for returns or refusal of the artwork are outlined in Section 3 – Returns and Refund Policy, and they apply fully to custom orders as well.
